Can You Rent Out a Snowbird Vacation Home in Panama City, FL? Rules, HOAs and What to Expect

Sometimes, but not automatically — and that is the part that surprises people. Whether you can rent out a snowbird vacation home in Panama City, FL depends on three separate layers of rules: your HOA or condo association documents, the local government where the property sits, and the state licensing requirements. The association is usually the strictest of the three, and it is the one buyers check last. Here is how to check it first.


Layer 1: Your HOA or Condo Association


This is the one that decides your answer most of the time. An association's recorded declaration can prohibit short-term rentals outright or set a minimum lease term — 30 days, 90 days and six months are all common along the Emerald Coast. Some communities also cap how many times per year you may lease, or require board approval of every tenant. None of that is overridden by what the city or county allows.


This matters especially in 55+ communities. Active adult communities are built around residents, not rotating vacationers, so they tend to limit leasing far more tightly than a beachfront condo building does — and any tenant still has to satisfy the community's age requirements. If rental income is central to your plan, read the declaration before you fall in love with a floor plan.



Layer 2: Which Local Government You Are Actually In


"Panama City Beach" on a mailing address does not always mean inside city limits, and the rules differ. Inside the city, vacation rentals must hold a valid certificate, register through the city's portal, and pass a fire inspection, with registration and re-inspection fees plus penalties for renting without one. The City of Panama City Beach publishes the current requirements, fee schedule and inspection process on its short-term rentals page. Unincorporated Bay County follows its own process. Confirming which jurisdiction a property sits in is a five-minute check that saves a lot of grief.


Layer 3: State Licensing and Taxes


Florida licenses vacation rentals at the state level, and short stays are subject to sales tax plus the county tourist development tax, which owners or their platform must collect and remit. A local business tax receipt is typically required as well. If you plan to hire a management company, ask exactly which of these they handle and which stay in your name — the answer varies by company.


A Quick Checklist Before You Make an Offer


Request the recorded declaration and current rules — not the marketing summary. Look specifically for minimum lease term, leases per year, tenant approval, and any pending amendment on rentals.


Confirm the jurisdiction and its registration process. City limits versus unincorporated county changes your fees, your inspection and your signage requirements.


Budget the carrying costs honestly. Association dues, insurance, management fees, cleaning, utilities and off-season vacancy all come out before profit. Summer is peak here; midwinter is quiet.


Decide what the home is really for. If it is primarily your winter home and rental income is a bonus, a longer-minimum-lease community may suit you fine. If the income is the point, you need a property where short stays are clearly allowed.

Can my HOA really stop me from renting if the city allows it?

Generally yes. Association declarations are recorded restrictions that run with the property, and a city allowing vacation rentals does not obligate your association to permit them. When the two conflict, you follow the stricter one — and that is almost always the association. Can I rent my place to another snowbird for the season?

Seasonal leases of a month or longer are far more widely permitted than nightly stays, and in many communities that is the workable middle ground: you use the home during your months, a seasonal tenant covers part of the carrying cost during theirs. Check the minimum term and the leases-per-year cap, since those two together decide whether the plan works.


Does renting it out affect my homestead exemption?

If the property is a second home rather than your Florida primary residence, homestead was not on the table to begin with.
